Introduction

June 30, 2026 is the date software developers and deployers across the US have been watching since Colorado Governor Jared Polis signed Senate Bill 24-205 into law on May 17, 2024. On that date, Colorado’s Consumer Protections for Artificial Intelligence Act (CAIA) becomes enforceable — making it the first comprehensive state-level AI statute in the United States to reach full effect. If your company builds or deploys AI systems that make decisions affecting Colorado consumers, you have roughly 100 days to get compliant.

The deadline was already pushed once. An August 2025 special session produced SB 25B-004, which delayed enforcement from February 1, 2026 to June 30. That five-month extension was an administrative compromise, not a signal that the law is softening. Substantively, the statute is unchanged — and the Colorado Attorney General’s office has enforcement authority starting day one.

What Makes an AI System “High-Risk”

The CAIA targets systems that make — or substantially influence — what the law calls “consequential decisions.” The list covers eight sectors: education, employment, lending, insurance, housing, healthcare, government services, and legal services. An AI tool used to screen job applicants, evaluate loan applications, or triage patient records almost certainly falls under this definition. A customer service chatbot that only routes tickets probably doesn’t.

The statute’s central legal concept is algorithmic discrimination: any condition in which an AI system produces unlawful differential treatment based on a protected characteristic — age, race, disability, national origin, reproductive health status, or a dozen others listed in the law. Discrimination doesn’t require intent. If your model produces disparate outcomes for protected groups, you face exposure regardless of how the model was originally trained.

Developer Obligations: Documentation and Disclosure

If you build or substantially modify a high-risk AI system, the CAIA requires you to exercise “reasonable care” to prevent algorithmic discrimination and to document what you’ve built. That documentation must cover the system’s intended purpose and foreseeable uses, the type and governance of training data, known limitations, and evaluations conducted to address bias. You must make that documentation available to any deployer using your system.

The disclosure trigger is tight: if you discover that your system has caused, or is likely to have caused, algorithmic discrimination, you have 90 days to notify the Attorney General, all downstream deployers, and any other affected developers. That window starts from the date you become aware — not the date you investigate and confirm. Companies that wait for certainty before notifying will find themselves outside the cure window.

Deployer Obligations: Policies, Assessments, and Notices

Deployers — the companies that actually use high-risk AI to make decisions about people — carry the heaviest operational burden. The statute requires a formal risk management policy and program built around an established framework. The Colorado legislature named the NIST Artificial Intelligence Risk Management Framework (AI RMF) and ISO/IEC 42001 as reference standards. If your organization already aligns with one of these, you have a head start; if not, the time to start is now.

Impact assessments must be completed before deployment, repeated annually, and re-run within 90 days of any “substantial and intentional modification” to the system. These assessments must be retained for at least three years after the system’s final deployment. Deployers must also notify consumers before a consequential decision is made — in plain language, in all languages they typically communicate in, and in formats accessible to consumers with disabilities.

Consumer Rights and Adverse Decision Notices

When a high-risk AI system produces an adverse outcome — a loan denied, an application rejected, coverage withheld — deployers must explain what happened. Consumers have the right to know what data was used in the decision, to correct any inaccurate personal information that influenced the outcome, and to appeal via human review if that’s technically feasible. These aren’t aspirational principles; they’re enforceable obligations with documented compliance requirements behind them.

Any AI system deployed to interact directly with consumers — including AI agents and chatbots — must disclose its nature upfront. The law’s language is broad enough to catch most conversational AI deployed in consumer-facing contexts in Colorado. If the system can affect a consequential decision, the consumer must know they’re talking to an AI and understand what it might decide about them.

Enforcement: $20,000 Per Violation and a 60-Day Cure

The Colorado Attorney General holds exclusive enforcement authority. There is no private right of action, which means individual consumers can’t sue companies directly under the CAIA. This concentrates enforcement risk around formal AG investigations rather than class-action litigation — a meaningful distinction from how other consumer protection claims typically play out.

Violations are treated as deceptive trade practices under Colorado’s Consumer Protection Act, with a maximum civil penalty of $20,000 per violation. Critically, violations are counted per consumer or transaction, so systematic non-compliance across many affected users stacks quickly into serious exposure. Before any enforcement action, the AG must issue a notice giving organizations 60 days to cure. Companies that can demonstrate they identified a problem, fixed it, and aligned with NIST AI RMF or ISO 42001 have an affirmative defense against penalties — which makes early detection and remediation worth real investment.

Colorado, the EU AI Act, and 78 State Bills

Colorado isn’t operating in isolation. The EU AI Act’s compliance deadlines run through August 2026, meaning global companies face two overlapping frameworks in the same summer. The EU regime covers broader categories of high-risk AI — including biometric identification and law enforcement tools the CAIA doesn’t address — and carries far steeper penalties: up to 7% of global annual revenue or €35 million, whichever is higher. Colorado is also one node in a rapidly expanding US state regulatory map. As of early 2026, 78 AI bills are active across 27 states, according to the Transparency Coalition’s March 2026 legislative tracker. Several states are explicitly modeling their bills on the CAIA’s structure. How Colorado’s Attorney General enforces the law over its first 12 months will likely shape how other states calibrate their own statutes — and whether Congress sees sufficient pressure to pursue federal AI legislation that preempts the state patchwork. The businesses best positioned won’t be those who started three months ago; they’ll be the ones who completed their AI inventory, drafted NIST-aligned impact assessment templates, and ran a pre-launch compliance review before Q2 ends. Whether federal legislation eventually supersedes state patchwork or not, treating AI governance as optional is no longer viable in the US.
